Terms of service

Niambie helps businesses set up, connect and run their own WhatsApp Business Platform account: templates, reminders, campaigns, appointments, receipts, replies and reports.

You own your Meta account, your number and your data. Gahitwen provides setup, management and support.

You confirm that you have legal capacity to accept these terms and authority to represent your business.

The information you provide must be accurate and current. You are responsible for the security of your sign-in credentials and the use of your account.

You must obtain valid consent before sending business messages, especially marketing. You must honour opt-outs (for example STOP, ACHA, SITAKI) immediately and not message someone who has opted out.

You must ensure your content is lawful, accurate and does not breach the law, the rights of others or Meta policies.

For clinics and health services, you agree not to send health information, diagnoses, treatment details or medicine promotions through Niambie. Health Mode stores only name, phone, service and time.

You are responsible for your number quality, your business verification and your Meta payments.

The service depends on the WhatsApp Business Platform and is provided subject to the Meta Platform Terms, WhatsApp Business Terms, WhatsApp Business Messaging Policy and WhatsApp Commerce Policy.

Meta may change rules, limits or prices, or suspend an account. We follow Meta decisions and may pause sending to protect quality or comply with the law.

Prescription drugs, over-the-counter drugs and medical devices may not be sold or promoted through WhatsApp commerce features.

You pay Gahitwen a service fee according to your package. You pay Meta directly for message fees with your own card; Gahitwen does not take Meta’s payment and does not mark it up.

Meta prices can change every quarter. Our figures are estimates; Meta’s invoice is final.

Gahitwen fees exclude taxes and bank charges and are non-refundable unless the law requires otherwise.

Templates require Meta approval. Meta may recategorise a template or reject content. Free-form messages are allowed only inside the 24-hour window after a customer message.

We enforce daily limits, quiet hours, marketing caps and opt-outs. We cannot guarantee delivery, read receipts or replies.

You may not send spam, fraud, threats, sexual content, weapons, unlawful alcohol or tobacco, gambling where restricted, or goods and services prohibited by Meta or the law.

You may not attempt to break the security of the service, access another client’s data, or use the service to breach Tanzanian or other applicable law.

Niambie, its name, interface and documentation belong to Gahitwen or its licensors. We grant you a non-exclusive licence to use the service for the term of the agreement.

You keep ownership of your data, content and trademarks. You give us permission to use that content to provide the service.

We try to keep the service available, but we may pause it for maintenance, security, Meta or network reasons.

We may change the service or these terms. Material changes will be notified and take effect after a reasonable period.

We may suspend or end the service if you breach these terms, Meta policies or the law, or if payment is missing or there is a security risk.

You may end the service with 30 days’ notice. After termination we return or delete data under the Privacy Policy and Data Processing Terms.

The service is provided “as is”. To the maximum extent permitted by law, Gahitwen is not liable for indirect loss, lost profit or data caused by Meta decisions, networks, misuse or events outside our control.

Nothing in these terms limits rights that the law does not allow us to exclude.

These terms are governed by the laws of Tanzania. To the extent the law allows, the courts of Tanzania have jurisdiction over disputes.

Before legal action, we agree to try to resolve a dispute through good-faith discussion.
